("Sedatech", “our”, "we" or "us"), in relation to the services and products offered by us through this website. By accessing our Website and/or placing an order with us, you confirm that you have read, understood and agree to be bound by these Terms and the details set out in your order.
§ 1 Information relating to products
The entire Sedatech team has made every effort to assure the accuracy of all information on the Website. However we do not guarantee that there will be no errors in the description and/or pricing of the products, nor that all products will always be available if you wish to place an order to purchase them. All images, illustrations and descriptions of products are for information only.
We reserve the right, at any time and without notice, to modify the information about the products displayed on our Website, including without limitation information on prices, description and availability. However, changes to price, availability or description will not affect orders submitted by you which have already been accepted by us. The foregoing will not affect your statutory rights relating to misdescribed Goods.
§ 2 Order process
You place an order for one or more products on the Website by completing the check-out process and following the online instructions via clicking on the "Basket" link on the Website; you will be guided through the order process by following a series of simple online instructions.
You may only purchase products from our Website if you are at least 18 years old.
Save in manifest error on our part, the price for the products shall be the price stated in the relevant order confirmation. We reserve the right to refuse any order where the price is incorrectly stated on the website or on the order confirmation.
Our order process allows you to check and amend errors before submitting your order to us. Please take the time to read and check your order at each page of the order process. If you need to amend your order after it has been submitted, it will be necessary to cancel it by contacting our customer services team from Monday to Friday, 8-4pm GMT by telephone on 0049 304 467 7936 or via our contact form.
During the checkout process you will be asked to enter your payment details. You must complete all fields that are marked as compulsory. Please note that your payments details will not be stored.
After submitting an order via our website we will send you an order acknowledgement by email confirming receipt of your order and details of the products that you have ordered. It is your responsibility to check the order acknowledgement details and advise us of any errors or omissions as soon as possible and in any event within 2 (two) days of receipt of the order acknowledgement.
Completion of the online check-out process and our email acknowledging receipt are not an acceptance of your order.
Acceptance of your order for Products and the formation of a contract between you and Sedatech will take place when the products you have ordered have been dispatched to you and you have received a dispatch confirmation email from us.
A contract will not be formed if we have notified you that we do not accept your order or if you have cancelled your order in accordance with our cancellation and returns policy.
All products that you order through the website will remain our property until we have received payment in full from you for those products.
We may decline your order (or part of it) for any reason. Other than set out in these terms, we will not be responsible for any loss or damage you might suffer due to us not accepting or otherwise declining your order.
§ 3 Pricing
The total price payable will be stipulated at the time of order whether the order has been acknowledged or not. All prices are inclusive of VAT.
§ 4 Cancellation of your order
You have the right to cancel your purchase at any time either before or up to 14 days following the day you receive the goods by contacting us via our contact form stating your name, a description of the products concerned and the order number. The right of withdrawal does not apply to business customers.
Prior to returning any goods received, you must first contact us and obtain our authorisation.
If you exercise your right to cancel your order after the products have been dispatched, we will send you a prepaid label to return the product, so that you don’t have to pay for shipping. However, if you wish to use a shipping method other than the one we offer, then shipping costs must be borne by you.
Your product must be returned complete and in "as new" condition. Computers may be opened but product or components must not be damaged or marked, and seals must not be broken.
It should be returned with the original box, packaging and accessories received with it.

§ 5 Delivery of your order
We offer free standard delivery with DHL to all EU countries.
Please check your delivery information before ordering. If a product is returned to us because of inaccurate, incomplete or incorrect delivery information, return costs may be charged to you.
As soon as the product has been dispatched, you will receive a tracking number which will allow you to track the shipment. Please check the location your shipment regularly for updates. In the event of your absence at time of delivery, the parcel may be deposited in the nearest DHL or UPS branch, depending on the shipment method you have chosen. If a product is returned because it has not been collected from the branch, return costs may be charged to you.

§ 7 General terms
Neither our nor your failure to enforce any term from these Terms of Sale constitutes a waiver of said term. Such failure shall in no way affect the right to enforce such term later.
§ 8 Disclaimer and limitations of liability
If we fail to comply with the here-mentioned terms, we are responsible for any loss or damage you suffer that is a foreseeable result of our breach of these terms or our negligence. However, we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if the possibility of it occurring was conceived by both parties at the time of entering into the contract.
§ 9 Intellectual property rights
The Sedatech trade mark as well as all trade marks, whether figurative or not, and all other marks, illustrations, images, and logo which appear on our products, accessories or packaging, whether registered or not, are and remain the exclusive property of Sedatech Europe GmbH. Any reproduction, whether complete or partial, modification or use of these marks, illustrations, images and logo, for whatever reason and in whatever medium, without our written, express and prior agreement, is strictly prohibited and will be prosecuted.
§ 10 Applicable law, claim and online dispute resolution
These terms of sale are governed by the law of Germany implementing the European Directive on the protection of consumers with respect to distance contracts, without regard to its conflicts of laws provisions. In so far as it is permitted by the applicable laws on consumer protection, any action or claim related to these terms of sale shall be submitted to the exclusive jurisdiction of the courts of Germany.

In case the answer provided by our Claim Service is unsatisfactory, we inform you that in order to settle a dispute generated by a contract of sale finalised online out of court, and without any detriment to the consumer's right of access to the protection of the judiciary system, it is possible to submit an online complaint on the European platform for online dispute resolution (ODR) at the following address link, in compliance with the provisions of (EU) Regulation No. 524/2013 of the European Parliament and Council of 21 May 2013 regarding resolution of online consumer disputes.
